1. Scope
SAM Sports- & Marketing AG operates its online shop at www.sp-connect.ch.
These General Terms and Conditions apply exclusively to all business relationships between you and SAM Sports- & Marketing AG (hereinafter also referred to as “SAM AG”) in the version valid at the time the contract is concluded. Any deviating conditions on your part shall not be recognized unless SAM AG has expressly agreed to them in writing.
By placing an order, you agree to these General Terms and Conditions, which become an integral part of the individual purchase contract. Amendments to our General Terms and Conditions become effective upon publication on www.sp-connect.ch.
2. Conclusion of Contract
Your order constitutes a binding offer to enter into a contract with us.
When you place an order on www.sp-connect.ch, you will receive an email confirming receipt of your order, including details of the ordered products, delivery, and payment conditions (“Order Confirmation”). The purchase contract is concluded upon receipt of this Order Confirmation, which also constitutes acceptance of the order.
Once the ordered goods are shipped, you will receive an additional email confirming shipment (“Shipping Confirmation”).
The place of performance for all obligations arising from the contract is our registered office.
SAM AG reserves the right not to accept online orders until the contract has been formally accepted. If an order cannot be fulfilled, you will be informed by email, including cases where quantities exceed normal household amounts or products are exceptionally unavailable.
Applicable Law and Jurisdiction
Unless mandatory statutory provisions provide otherwise, Austrian law shall apply. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and all related provisions are expressly excluded.
The contract language is German.
The parties agree to Austrian domestic jurisdiction. Mandatory legal provisions applicable at the consumer’s place of residence shall also apply where required by law.
If the transaction is not a consumer transaction, the court with subject-matter jurisdiction at the registered office of our company shall have exclusive local jurisdiction for all disputes arising from the contract.
3. Right of Withdrawal
3.1 Right of Withdrawal for Austrian Consumers
3.1.1 Right of Withdrawal
You may withdraw from a distance-selling purchase contract within 30 days without stating any reason.
The withdrawal period begins upon receipt of this notice in text form, but not before the goods have been received by the customer. The day triggering the period (contract conclusion or receipt of goods) is not counted.
Withdrawal may be declared in writing by email or letter within the withdrawal period. Timely dispatch of the goods to the following address is sufficient to comply with the deadline:

Exceptions to the right of withdrawal are outlined in section 3.3.
3.1.2 Consequences of Withdrawal and Compensation
In the event of a valid withdrawal, both parties must return any received services and surrender any derived benefits (e.g. interest), unless exceptions under section 3.3 apply.
If you are unable to return the goods in full, partially, or only in deteriorated condition (e.g. showing signs of use, damage, or dirt), you may be required to provide compensation for the loss in value.
A deterioration resulting solely from a short-term inspection of the goods, comparable to what would be possible in a retail store, does not constitute grounds for compensation.
Returns resulting from a valid withdrawal are free of charge within Austria.
Refunds for goods received by us in completely undamaged and unused condition will be issued within 30 days.
3.2 Right of Withdrawal for German and EU Consumers (excluding Austria)
3.2.1 Right of Withdrawal
You may revoke your contractual declaration within 30 days without stating any reason in writing (email or letter) or, if the goods are delivered before the deadline expires, by returning the goods.
The withdrawal period begins upon receipt of this notice in text form, but not before receipt of the goods by the recipient and not before fulfillment of our statutory information obligations.

3.2.2 Consequences of Withdrawal
In the event of a valid withdrawal, both parties must return any received services and surrender any derived benefits (e.g. interest).
If the goods cannot be returned in full or only in deteriorated condition, compensation may be required.
Returns resulting from a valid withdrawal are free of charge from Finland.
Return shipping costs from all other countries are not reimbursed by SP United Vertriebs GmbH.
3.3 Exceptions to the Right of Withdrawal
There is no right of withdrawal for contracts concerning:
- Goods manufactured according to customer specifications (e.g. Edition Phone Cases)
- Non-prefabricated goods requiring an individual selection or determination by the consumer
- Products offered at heavily discounted prices under the “Sale” category
Goods suitable for parcel shipment must be returned by the consumer. Goods not suitable for parcel shipment will be collected by us.
4. Prices
All webshop prices include VAT applicable at the time of the order, plus shipping costs.
5. Payment Terms
You may choose between various payment methods:
a) Credit Card
VISA, MASTERCARD, AMEX
Please enter your credit card details during checkout. Our system ensures secure data transmission using SSL encryption at all times.
b) PayPal
PayPal is an online payment service designed specifically for online purchases.
c) Apple Pay
Apple Pay is a payment system developed by Apple for compatible mobile devices and supported apps.
d) Prepayment
Please transfer the total amount stated in the order confirmation free of charge to the following account:

Delivery will be made immediately after receipt of payment.
Klarna
The use of invoice purchase, installment purchase, and direct debit requires a successful credit check.
6. Delivery / Shipping Costs
We deliver to all EU countries.
Unless otherwise agreed, delivery is made to the address specified by you.
All information regarding availability, shipping, or delivery times is non-binding and indicative only.
Goods are generally ready for shipment within 24 hours.
Delivery is subject to stock availability.
SAM AG reserves the right to withdraw from the contract if ordered goods are unavailable.
7. Retention of Title
Delivered goods remain the property of SAM AG until full payment of the purchase price and shipping costs has been received.
8. Warranty
Warranty claims for our products are governed by Austrian law.
Assignment of warranty claims is excluded.
Any claims for damages resulting from slight negligence by SAM AG are excluded in full.
9. Privacy Policy
The address and order data provided by you are stored and processed electronically in accordance with applicable data protection laws.
Your information is used exclusively for processing orders, customer communication, account management, and marketing purposes.
You may object to the use of your data for marketing purposes at any time by emailing support@sp-connect.ch.

10. Copyright
All elements of the SAM AG website are the exclusive intellectual property of SAM AG.
Copying or reproducing this website, including printing, is permitted solely for placing orders or using the website as a shopping resource.
Any other use, reproduction, redistribution, modification, or publication requires prior written consent from SAM AG.
11. Severability Clause
Should any provision of these General Terms and Conditions become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
